Furthermore, you give SoccerBuddy the rights to sublicense these rights. SoccerBuddy will not pay or otherwise compensate you for the submission of the materials. SoccerBuddy has the right to monitor and read the materials you submit and delete or modify them at any time without any obligation to present any basis for the deletion or modification. You present that you have all necessary rights for each submitted material to enable you to give SoccerBuddy the rights granted in this section. SoccerBuddy will have the right, to the maximum extent permitted by applicable law to monitor your electronic communications, and disclose any information in the event SoccerBuddy has in good faith a reason to believe that your conduct is not in accordance with this agreement, and while protecting the rights of SoccerBuddy, or a third party.

NO WARRANTIES
The website and its services are offered “as is”. You acknowledge that software and services in general are not error-free and agree that the existence of such errors shall not constitute a breach of this Agreement. You accept the entire risk concerning quality, performance, accuracy and effort.

SoccerBuddy exclusively reserves all rights concerning the website and its services and may, at any time and without any prior notice modify or discontinue the website and its services temporarily or permanently. SoccerBuddy will take no responsibility for any lost data due to any reason, including but not limited to termination of the services, software error or failures in storing or delivering the data.

SoccerBuddy disclaims all warranties, either express or implied, including the implied warranties of merchantability and fitness for a particular purpose in any part of the world.

LIMITATION OF LIABILITIES
In no event will SoccerBuddy be liable for any consequential, indirect or special damages, loss of profits or loss of business or personal incomes arising out of any breach of this Agreement. This limitation applies without regard to if the damages are caused by breach of this agreement, warranty, negligence or any other cause of action to the extent such limitation is not prohibited in by applicable law. If you do not agree with any part of this agreement, or you are dissatisfied with the website or its services, or you have a dispute or claim against SoccerBuddy concerning this agreement or the website or its services, your sole and exclusive remedy is to discontinue using the website and its services.

Without limiting the generality of this section, you agree that SoccerBuddy is not responsible nor liable for (A) any content, including without any limitation, any infringing, inaccurate, obscene, indecent, threatening, offensive, defamatory, tortuous, or illegal content, OR (B) any third party conduct, transmission or data, OR (C) any viruses or other detrimental features that affect the use of the website or services, or cause temporary or permanent damage to your equipment or software, (D) any delays or failures in initiating, conducting or completing any transmissions or transactions in connection with this website and its services, or (E) any damages or costs arising out of or in any way connected with your use of the website or its services. These limitations of liability apply to the maximum extent permitted by applicable law.

TERMINATION
SoccerBuddy may, at any time with or without cause, with or without prior notice, terminate this Agreement or suspend your access to the website and its services, or terminate your account. Upon such termination, you will no longer have the right to use the website or its services. Upon termination, SoccerBuddy may at its sole discretion delete the information and materials you have stored and may not store or retrieve these later.
